  1. Norwegian Licence for Open Government Data (NLOD)
  2. Preface of licence
  3. This licence grants you the right to copy, use and distribute information,
  4. provided you acknowledge the contributors and comply with the terms and conditions
  5. stipulated in this licence. By using information made available under this
  6. licence, you accept the terms and conditions set forth in this licence. As
  7. set out in Section 7, the licensor disclaims any and all liability for the
  8. quality of the information and what the information is used for.
  9. This licence shall not impose any limitations on the rights or freedoms of
  10. the licensee under the Norwegian Freedom of Information Act or any other legislation
  11. granting the general public a right of access to public sector information,
  12. or that follow from exemptions or limitations stipulated in the Norwegian
  13. Copyright Act. Further, the licence shall not impose any limitations on the
  14. licensee's freedom of expression recognized by law.
  15. 1. Definitions
  16. «Database» shall mean a database or similar protected under Section 43 of
  17. the Norwegian Copyright Act.
  18. «Information» shall mean texts, images, recordings, data sets or other works
  19. protected under Section 1 of the Norwegian Copyright Act, or which are protected
  20. under provisions addressing what is referred to as «neighbouring rights» in
  21. Chapter 5 of the Norwegian Copyright Act (including databases and photographs),
  22. and which are distributed under this licence.
  23. «Copy» shall mean reproduction in any form.
  24. «Licensee» and «you» shall mean natural or legal persons using information
  25. under this licence.
  26. «Licensor» shall mean the natural or legal person that makes information available
  27. under this licence.
  28. «Distribute» shall mean any actions whereby information is made available,
  29. including to distribute, transfer, communicate, disperse, show, perform, sell,
  30. lend and rent.
  31. «Use» shall mean one or more actions relevant to copyright law requiring permission
  32. from the owner of the copyright.
  33. 2. Licence
  34. The licensee, subject to the limitations that follow from this licence, may
  35. use the information for any purpose and in all contexts, by:
  36. * copying the information and distributing the information to others,
  37. * modifying the information and/or combining the information with other information,
  38. and
  39. * copying and distributing such changed or combined information.
  40. * This is a non-exclusive, free, perpetual and worldwide licence. The information
  41. may be used in any medium and format known today and/or which will become
  42. known in the future. The Licensee shall not sub-license or transfer this licence.
  43. 3. Exemptions
  44. The licence does not apply to and therefore does not grant a right to use:
  45. * information which contains personal data covered by the Norwegian Personal
  46. Data Act unless there is a legitimate basis for the disclosure and further
  47. processing of the personal data
  48. * information distributed in violation of a statutory obligation to observe
  49. confidentiality
  50. * information excluded from public disclosure pursuant to law, including information
  51. deemed sensitive under the Norwegian National Security Act
  52. * information subject to third party rights which the licensor is not authorised
  53. to license to the licensee
  54. * information protected by intellectual property rights other than copyright
  55. and neighbouring rights in accordance with Chapter 5 of the Norwegian Copyright
  56. Act, such as trademarks, patents and design rights, but this does not entail
  57. an impediment to use information where the licensor's logo has been permanently
  58. integrated into the information or to attribute the origin of the information
  59. in accordance with the article below relating to attribution.
  60. If the licensor has made available information not covered by the licence
  61. according to the above list, the licensee must cease all use of the information
  62. under the licence, and erase the information as soon as he or she becomes
  63. aware of or should have understood that the information is not covered by
  64. the licence.
  65. 4. Effects of breach of the licence
  66. The licence is subject to the licensee's compliance with the terms and conditions
  67. of this licence. In the event that the licensee commits a breach of this licence,
  68. this will entail that the licensee's right to use the information will be
  69. revoked immediately without further notice. In case of such a breach, the
  70. licensee must immediately and without further notice take measures to cause
  71. the infringement to end. Because the right to use the information has been
  72. terminated, the licensee must cease all use of the information by virtue of
  73. the licence.
  74. 5. Attribution
  75. The licensee shall attribute the licensor as specified by the licensor and
  76. include a reference to this licence. To the extent practically possible, the
  77. licensee shall provide a link to both this licence and the source of the information.
  78. If the licensor has not specified how attributions shall be made, the licensee
  79. shall normally state the following: «Contains data under the Norwegian licence
  80. for Open Government data (NLOD) distributed by [name of licensor]».
  81. If the licensor has specified that the information shall only be available
  82. under a specific version of this licence, cf. Section 10, the licensee shall
  83. also state this.
  84. If the information has been changed, the licensee must clearly indicate that
  85. changes have been made by the licensee.
  86. 6. Proper use
  87. The licensee shall not use the information in a manner that appears misleading
  88. nor present the information in a distorted or incorrect manner.
  89. Neither the licensor's nor other contributors' names or trademarks must be
  90. used to support, recommend or market the licensee or any products or services
  91. using the information.
  92. 7. Disclaimer of liability
  93. The information is licensed «as is». The information may contain errors and
  94. omissions. The licensor provides no warranties, including relating to the
  95. content and relevance of the information.
  96. The licensor disclaims any liability for errors and defects associated with
  97. the information to the maximum extent permitted by law.
  98. The licensor shall not be liable for direct or indirect losses as a result
  99. of use of the information or in connection with copying or further distribution
  100. of the information.
  101. 8. Guarantees regarding data quality and accessibility
  102. This licence does not prevent the licensor from issuing supplementary statements
  103. regarding expected or intended data quality and accessibility. Such statements
  104. shall be regarded as indicative in nature and not binding on the part of the
  105. licensor. The disclaimers in Section 7 also apply in full for such indicative
  106. statements. Based on separate agreement, the licensor may provide guarantees
  107. and distribute the information on terms and conditions different from those
  108. set forth in this licence.
  109. 9. Licence compatibility
  110. If the licensee is to distribute an adapted or combined work based on information
  111. covered by this licence and some other work licensed under a licence compatible
  112. by contract, such distribution may be based on an appropriate licence compatible
  113. by contract, cf. the list below.
  114. A licence compatible by contract shall mean the following licences:
  115. * for all information: Open Government Licence (version 1.0),
  116. * for those parts of the information which do not constitute databases: Creative
  117. Commons Attribution Licence (generic version 1.0, 2.0, 2.5 and unported version
  118. 3.0) and Creative Commons Navngivelse 3.0 Norge,
  119. * for those parts of the information which constitute databases: Open Data
  120. Commons Attribution License (version 1.0).
  121. This provision does not prevent other licences from being compatible with
  122. this licence based on their content.
  123. 10. New versions of the licence
  124. The licensee may choose to use the information covered by this licence under
  125. any new versions of the Norwegian licence for Open Government data (NLOD)
  126. issued by the responsible ministry (currently the Ministry of Government Administration,
  127. Reform and Church Affairs) when these versions are final and official, unless
  128. the licensor when making the information available under this licence specifically
  129. has stated that solely version 1.0 of this licence may be used.
  130. 11. Governing law and legal venue
  131. This licence, including its formation, and any disputes and claims arising
  132. in connection with or relating to this licence, shall be regulated by Norwegian
  133. law. The legal venue shall be the licensor's ordinary legal venue. The licensor
  134. may, with regard to intellectual proprietary rights, choose to pursue a claim
  135. at other competent legal venues and/or based on the laws of the country where
  136. the intellectual property rights are sought enforced.
